Now, normally I would completely agree with those people complaining that Live was kinda down over the holidays (personally I didn't notice, but that's besides the point), but as soon as a couple of idiots in Texas decided that they should start up a class action suit against MS, my sympathy dried up.
Anyway, the good news to come out of all of this is that MS is going to be giving everyone a free XBLA title for their troubles. Whether this will be a new release that has it's price waived, or if it'll be a time sensitive download, they aren't saying yet.
If I were a betting man, my money would be on something that's already been released that was developed specifically by Microsoft (Hexic 2, anyone?)

I already got hexic 2 free....
Sometimes I feel like microsoft gives away too many free games.
There's already 4 permanently free arcade games (hexic HD, totemball, yaris, Aegis wing)
And another 1 coming out (doritos, ramage of destruction- or something)
also there have been other games that have been free for a certain amount of time (texas hold 'em, carcassone), and arcade games are bundled with memory cards and acessories.
I hope microsoft isn't hurt too much by this, they have just had crappy luck these couple months.
Microsoft gives away too many free games? There's a thought I've never had.
It would be nice if they gave us a choice of games rather than just one, as a lot of people are going to be unhappy again if it's something they've already bought, but any decent (not like Yaris) free game is a good thing.

Your sympathy dried up just because of those guys? This whole thing has been a royal screwup on Microsofts part, and people had every right and then some to be totally pissed off about this whole thing. Personally, I didn't care I couldn't play games online myself, but not being able to fully connect made me unable to play a majority of my XBLA games AT ALL because of having to send 2 systems back, and MS not doing a damn thing with the DRM issues irked the crap out of me. Add on top of that games that do DLC check when you start them up single player (such as Oblivion) were completely crippled because of this. Microsofts lack of communication to a majority of its customer base as well (one man updating his twitters doesn't count as communication to all the customers from a main company, if people don't go to or know about the website) was piss poor. Least they could have done was send a mass email to every GT to let them know there are issues, instead of people thinking something is wrong with their system, ISP, etc.
Onto the free game thing, I highly doubt they'd give a game away that's already been released, because then another storm would start up. Knowing Microsoft though, it'll probably be a game that was already slated to be free, now they just don't have to tell us it was going to be initially. Gold paying members should be given a free week or something at least as an added bonus since we pay for this service, and I don't think one free week is much to ask for seeing as to how the service has been shoddy for about 2 or so now. They have enough codes for free 2 day trials, free month trials floating around out there, don't think it would hurt them to credit loyal customers one week.

Free games aren't bad, I just wonder how microsoft is making any profit off of xbla when there are so many that are free.

I'm surprised there isn't more sympathy for those of us (worldwide) who have been impacted by the Live issues over the past two weeks.
This site especially should be acutely aware of the well reported DRM issues that mean many people cannot play their XBLA games offline if they've moved to a replacement xbox360; that was but one major symptom of the Live issues, though one worthy of sympathy from an XBLA focused site.
I echo concerns this will be a game many people already have or that many people do not want, and am puzzled by the decision not to simply credit accounts with either a Live extension or a number of free points.

To those of you asking about my sympathy, let me clear it up a bit.
- I think it's a huge piss off
- I think MS should be adding a free month of Gold for all current gold members
- While I appreciate the XBLA game, it better be good
- Nothing pisses me off more than people who try and make situations like this into huge money grabs
The problem is if this goes to court, their is the possibility it could win. Not because it should, but because the average person dislikes big business and loves to punish them.I don't know about you, but I'd rather see MS spend the money on development than on lawyers.

Free gold time for memebers during the outage makes the most sense to me personally. Unless the xbla title is a previously unreleased game people will still end up complaining if they already purchased it and that sort of person won't halt complaints in that case.
Although with the latest info showing only a modest percent increase in gold members and XBLA users (of total 360 owners) MS may be trying to use this as a way to spread the word of XBLA titles. That is the sort of false business degree logic which is leading the game industry right now.
I don't understand the suing mentality personally, but the outages did prevent me from playing during my short vacation time. Combine that with my relatively short free playtime and I just decided it wasn't worth paying for gold anymore. Since I rarely have an hour to sit and play a game continously I usually play single player games anyway. if other people think the service is so bad then they should just choose to not renew it.
I know some game magazines have been calling 2007 the biggest game year on record, but personally I call it "2007 the year the game industry kept shooting itself in the foot".

so your loss of sympathy is confined to those boneheads in Texas. You probably don't need to worry much; MS has lots of money - and doesn't really spend it on development anymore; more publishing, really. They sure aren't spending it on xbox Live gear.
